1) BINDING EFFECT.

a) This is a binding agreement between you and Epic (“us”, “we”, “Company”). By using the Internet site located at https://Epic.co.za (the “Site”), you agree to abide by these Terms of Use as well as all applicable terms and policies. If at any time you find these Terms of Use unacceptable, you must immediately leave the Site and cease all use of it.
b) You agree that you shall not use the Website for illegal purposes and will respect all applicable laws and regulations. You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality, compromise the security or attempt to gain access to secured areas or sensitive information.
c) You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.

2) WEBSITE CHANGES

a) Epic Computers reserves the right to change any part of this agreement without notice and advises users to regularly check the Terms and Conditions of this agreement. Your use of the Website will be deemed as acceptance of this agreement. Epic may at its own discretion modify or remove any part of this site without warning or liability arising from such action.
3) PRICE CHANGES

a) All our pricing is subject to the rate of exchange at our distributors and while we strive to keep our prices current situations may arise that the prices change during your purchase. Should a price change occur we will notify the customer on their registered email address and give them the opportunity to either cancel their order and receive a full refund OR purchase the product at the new rate.

4) STOCK LEVELS

a) Stock is ordered from our suppliers as and when required and stock levels might change before we do our daily update. If a product is out of stock we will contact the customer with the relevant information as well as alternate products to select from.

5) WEBSITE IMAGES AND PRODUCT DESCRIPTIONS

a) While we do our best to supply correct images and descriptions for all our products please note that images are used for demonstration purposes only and the actual product we receive from the distributors may be different.

6) DISCLAIMERS

a) We strive to give our customers the best online shopping experience but we cannot guarantee that the website will be error free. The information contained within the Website is provided on an as is basis with no warranties expressed or otherwise implied.

7) GOVERNING LAW

a) These Terms of Use shall be construed in accordance with and governed by the laws of South Africa, without reference to rules regarding conflicts of law. This Site is intended for use by individuals based in South Africa.

8) MINIMUM AGE

a) You must be at least 18 years old to access and participate on this site. You guarantee and warrant you are at least 18 years old and are able to enter into this Agreement from a legal perspective.

9) EMAIL COMMUNICATIONS

a) When you contact us, you expressly consent and agree to receive email responses from us. These email communications may be commercial or non-commercial in nature. Non-commercial emails may include, but are not limited to, administrative issues and announcements of changes to these Terms, the Privacy Policy or other site documentation.

10) RETURNS POLICY

a) Epic Computers shall only accept returns within 7 days of receipt of delivery, provided the product is in its original packaging and in the same condition as when received. Refunds will be to the full amount of the original purchase price less shipping costs. After 7 days any product that has been opened will incur a 20% handling fee. All items must be in a re-sellable condition. If any goods or packaging are not in original condition they will be returned to the customer at the customer’s expense.
b) Items may only be returned for refund or replacement subject to the following restrictions:
c) All products must be returned in original condition. This includes all packaging, documentation, warranty cards, manuals, and accessories.
d) Software and consumables are non-refundable unless unopened and in their original packaging with all documentation.
e) Shipping, transaction and insurance fees are not refundable.
f) Epic Computers will always strive to supply the correct product to the customer however, should Epic Computers supply the wrong product or if the product is in any way faulty or damaged, Epic Computers will exchange it for the correct one. If the product was bought at a special rate and it is no longer being offered at that special rate, it will not be replaced, and Epic Computers will refund the buyers purchase price including delivery costs.

11) WARRANTIES

a) All items sold are covered by Manufacturers warranty for a minimum period of 1 year from date of purchase. If the product becomes faulty during the warranty period or the product is DOA (Dead On Arrival) please contact Epic Computers on [email protected] to arrange for the product to be returned to our suppliers for inspection and at their discretion, to be swopped out.
b) All warranties are immediately null and void should any equipment be tampered with or if the goods were operated outside the Manufacturer’s specifications.
c) Epic Computers will under no circumstances be liable for any damage arising from any misuse or abuse of goods. Customers should confirm that hardware is compatible with their operating system and any existing hardware prior to purchase. Epic Computers will not accept hardware returns as a result of operating system or hardware incompatibility.

12) AFFILIATED SITES

a) We have no control over and no liability for any third party websites or materials. We work with a number of partners whose Internet sites may be linked with the Site. Because we have no control over the content and performance of these partner and affiliate sites, we make no guarantees about the accuracy, currency, content, or quality of the information provided by such sites, and we assume no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content that may reside on those sites. Similarly, from time to time in connection with your use of the Site, you may have access to content items (including, but not limited to, websites) that are owned by third parties. You acknowledge and agree that we make no guarantees about, and assumes no responsibility for, the accuracy, currency, content, or quality of this third party content, and that, unless expressly provided otherwise, these Terms of Use shall govern your use of any and all third party content.

b) Epic Computers reserves the right to amend these Terms and Conditions.
c) Should a court of competent jurisdiction rule this Amendment provision invalid, then this Amendment clause shall be terminated as part of this agreement. All amendments to the Terms shall be forward looking.

a) WE HEREBY DISCLAIM ALL WARRANTIES. WE ARE MAKING THE SITE AVAILABLE “AS IS” WITHOUT WARRANTY OF ANY KIND.
